General terms of use and online sales

These General Terms of Use and Sale (hereinafter referred to as the "GTUS") are offered by ATV CYCLES SARL, with a capital of €10,000, a company registered with the Grenoble Trade and Companies Register under number 894455310, whose registered office is located at 5171 ROUTE DES TROIS VILLAGES, 38660 PLATEAU DES PETITES ROCHES – FRANCE (hereinafter "ATV CYCLES"ATV CYCLES »).

ATV CYCLES is a business specialised in the sale, assembly and repair of bicycles, which offers, through its website https://atv-cycles.fr/ (hereinafter the "Site"), the sale of bicycles, components and accessories for bicycles, equipment for cyclists as well as services related to the world of cycling (hereinafter the "Products and Services"). These GTUS apply without restriction or reservation to any purchase of Products and Services made on the website https://atv-cycles.fr/.Site »), la vente de cycles, composants et accessoires pour cycles, équipements pour cyclistes ainsi que des services liés à l’univers du cycle (ci-après les « Produits et Services » ). Les présentes CGUV s’appliquent sans restriction, ni réserve à tout achat de Produits et Services réalisés sur le site internet https://atv-cycles.fr/.

Each customer acknowledges having been informed, in a readable and understandable manner, of these GTUS as well as all the information necessary for the execution of these, in accordance with articles L.111-1 to L.111-8 of the Consumer Code, prior to placing their order and before any conclusion of their contract with ATV CYCLES.

1. APPLICATION AND ENFORCEABILITY OF THE GTUS

These GTUS apply, without reservation, to any use of the Site as well as to any order of Products and Services by any customer, natural person, acting for purposes that do not fall within the scope of their professional activity (hereinafter the "Customer") made on the Site, from 01/01/2024.Client ») réalisée sur le Site, à compter du 01/01/2024.

The purpose of these General Terms and Conditions of Sale (GTCS) is to define the conditions for ordering Products and Services, and to determine the respective rights and obligations of each party in the context of the provision of Products and Services.

Unless otherwise agreed in writing by the parties, these GTCS take precedence over any conflicting clauses arising from previously drafted general conditions, and thus apply to the exclusion of any other agreement.

These GTCS must be considered as an integral and essential part of the contract concluded between ATV CYCLES and each of its Clients.

These GTCS are systematically notified to the Client when creating their personal account on the Site and when placing their order on the Site. Each Client must necessarily acknowledge and accept them in order to validate their order on the Site. This also implies an express and unconditional acceptance by the Client of the Personal Data Protection Policy, of which the Client acknowledges having been informed. This acceptance consists of ticking the box corresponding to the acceptance statement of these GTCS, such as, for example, "I acknowledge that I have read and accepted all the general terms and conditions of sale published on the Site". Ticking this box will be deemed to have the same value as a handwritten signature from the Client.

In the event of modification and/or adaptation of these GTCS by ATV CYCLES, particularly to evolve its services or to comply with any new applicable regulations, only the version in force on the day of the Client's order on the Site will be validly applicable.

The fact that ATV CYCLES does not invoke, at any given time, any of the provisions of these General Terms and Conditions of Sale cannot be interpreted as a waiver of the right to invoke them later.

ATV CYCLES invites each Customer to read these General Terms and Conditions of Sale carefully, to print them and/or save them on any durable medium, before proceeding to order any Product or Service on its Site.

The applicable General Terms and Conditions of Sale will be those in force on the date of the Customer's order. It is therefore advisable for the Customer to regularly consult the General Terms and Conditions of Sale on the Site to stay informed of any new updates.

2. ACCESS AND AVAILABILITY OF THE SITE

ATV CYCLES offers free access to its Site, with the Customer remaining fully responsible for their computer equipment and Internet connection, the costs of which are their responsibility.

Access to the Site can be made:

  • from a computer or equivalent terminal with access to one or more telecommunications networks allowing access to the Internet and with Internet browsing software (such as Internet Explorer, Mozilla Firefox, etc.);
  • a telephone terminal with access to a telecommunications network allowing access to the Internet (3G, 4G, 5G, Edge, Wi-Fi, etc.).

 

ATV CYCLES makes its best efforts to keep the Site accessible at all times, subject to necessary maintenance operations for the proper functioning of the Site or the servers on which it is hosted. In the event of an interruption for maintenance, ATV CYCLES cannot be held responsible for any potential impact of this unavailability on the Customer's activities.

The Client is warned of the technical hazards inherent to the Internet and the access interruptions that may result. Consequently, ATV CYCLES cannot be held responsible for any unavailability or slowdowns of the Site.

The Client is informed that the servers of ATV CYCLES are hosted by the company INFOMANIAK, whose registered office is located at 25 Eugène Marziano Street – 1227 Les Acacias (GE) – Switzerland.

Any failure by the Client to comply with the obligations incumbent upon them under these General Terms and Conditions of Sale may result in the suspension or prohibition of the Client's access to the Site.

3. TERMS OF CONCLUSION OF THE CONTRACT

Orders for Product(s) or Service(s) are made through the Site.

The Products and Services for sale on the Site are reserved for individuals with full legal capacity to place orders on the Site. It is specified that the Products and Services are intended for the personal use of the Client and must not be related to their professional activity, including any resale or distribution of Products and Services.

Having a customer account is possible but is not a necessary and mandatory prerequisite for placing orders for Products and Services on the Site.

Creating a customer account is done through the following mandatory fields: Last name, first name, billing address, delivery address if different from the billing address, phone number, a valid email address, and a password. The customer account allows access to a personalised interface, to manage their profile and orders. However, in the case of incorrect information, the Customer may not receive emails or encounter other difficulties in placing, tracking, or receiving their order.

During each new visit, if they wish to place an order or consult their 'My Account' area, the Customer must first identify themselves using their strictly personal and confidential information chosen by them.

The Customer is required to maintain the confidentiality of their identifiers. In the event of loss, forgetfulness, or misuse of their identifiers by a third party, the Customer must immediately inform ATV CYCLES by contacting customer service by phone at +33 458 00 59 32 or by email at contact@atv-cycles.fr.

The Customer directly selects the Product(s) or Service(s) they wish to order on the Site. ATV CYCLES strives to provide visuals and descriptions that are as accurate as possible for the Products and Services. However, as these visuals and illustrative texts are not contractual, the Customer cannot hold ATV CYCLES liable in this regard.

Whether the Client has a customer account or not, they are required to verify or provide a certain number of information regarding themselves on the order validation page in order to validate it: Last name, first name, billing address, delivery address if it is different from the billing address, phone number, a valid email address. All orders must be duly completed and must contain this strictly necessary information for the order. The Client is responsible for the truthfulness, accuracy, and relevance of the data provided.

The Client may make changes, corrections, additions, or even cancel their order, up until the validation of the order on the order summary page, before payment.

4. PRODUCTS AND SERVICES

4.1 Products

Products are understood to mean all goods sold by ATV CYCLES that can be billed online and delivered to the Client via the Site.

4.2 Services

Services are understood to mean all services rendered or performed by ATV CYCLES on its premises or through its subcontractors and that can be billed online to the Client via the Site:

  • All labour services related to custom bicycle assembly
  • All labour services related to the repair and maintenance of bicycles or components
  • All services related to the rental of bicycles and accessories

 

The Services listed above are subject to regulatory display in-store and are identical to those displayed on the Site.

5. PURCHASE, PRICE, PAYMENT TERMS

5.1 Purchase

To make a purchase, the Customer must place their order directly on the Site. The Customer selects the Product(s) or Service(s) that match their search and adds them to their basket.

If the Customer already has a customer account on the Site and wishes to validate their order, they will be required to log in from the tab "Already a customer? Click here to log in" on the order validation page or by accessing their "My account" space, after logging in.

If this is a new Customer, they must either:

  • Follow the steps to create a customer account from the tab "Create an account" in the "I identify myself" section, and then proceed to the order;
  • Proceed to the order without creating a customer account by providing a number of details about themselves on the order validation page in order to validate it: Last name, first name, billing address, delivery address if it is different from the billing address, phone number, a valid email address.

 5.2 Prices & Taxes

Access to the Site as well as the presentation of Products and Services is free for the Customer. Only the order of one or more Products and Services will be subject to payment by the Customer.

The prices of the Products and Services are those actually displayed on the Site in Euros (€) including discounts and promotions as defined in paragraph 6.PROMOTIONAL CODES, COMMERCIAL OFFERS & NEWSLETTERS :

  • Among the member states of the European Union explicitly listed (excluding areas excluded from certain countries) in paragraphs 7.1 – Standard products, 7.2 – Frame kits and 7.3 – Bulky products or covered by the ADR standards, the Prices of Products and Services including discounts and promotions are indicated.all taxes included (ATI)including the VAT of the purchasing Client's country, under the new rules governing VAT since 1 July 2021, for the trade of goods sold to individuals between the member states of the European Union, the VAT applied is that of the purchasing Client's country. The developments of these rules are introduced by thearticle 147 of the finance law for 2020and thearticle 51 of the finance law for 2021. These articles transpose the European directivesno. 2017/2455andno. 2019/1995, as well as theimplementing regulation no. 2019/2026
  • for a client residing in a third country to the European Union explicitly listed (excluding areas excluded from certain countries) in paragraphs 7.1 – Standard products, 7.2 – Frame kits and 7.3 – Bulky products or covered by the ADR standard, the Prices of Products and Services including discounts and promotions are indicated.Excluding tax (ET) and in the currency of the relevant country.. In this case, ATV CYCLES takes care of the customs formalities by producing the CN23 declaration attached to the package. Delivery to DROM-COM, PO boxes and military bases is excluded.

ATV CYCLES reserves the right to temporarily or permanently exclude certain countries explicitly listed in paragraphs 7.1 – Standard products, 7.2 – Frame kits, and 7.3 – Bulky products or covered by the ADR standard for technical reasons related to the proper functioning of the Site or due to cost or logistical constraints beyond its control. In this case, the Customer will not be able to choose a delivery address in the countries affected by this restriction and proceed with their purchase.

The prices and VAT applicable are those valid on the day of the order on the Site by the Customer. Any change in the VAT rate may be reflected in the price of the Products.

After purchasing a product on the Site, the Customer will be responsible if they wish to export it to the DROM-COM or any countries not listed in paragraphs 7.1 – Standard products, 7.2 – Frame kits, and 7.3 – Bulky products or covered by the ADR standard. In this regard, the Customer will be considered an exporter and must complete customs formalities in accordance with the applicable laws and regulations. In this case, ATV CYCLES does not offer tax exemption on the products and no CN23 form or declaration will be provided to the Customer for this purpose.

The prices of the Products and Services indicated do not include delivery charges, which vary depending on the destination country and the delivery method chosen by the Customer at the time of order confirmation.

Delivery charges are fixed and indicated on the Site at the time of order confirmation by the Customer. Delivery charges are added to the price of the ordered Products.

ATV CYCLES reserves the right to change its prices at any time, provided that the price displayed online on the day of the order will be the price applicable to the Customer, unless there is a blatant pricing error of which the Customer will be informed as soon as possible.

Below the selling prices, the recommended public reference prices from the manufacturing equipment suppliers may be displayed. This reference price display is provided for informational purposes for the Customer.

The unit prices of the Products and Services, quantity(ies), any discounts, delivery method, delivery charges, and total amount of the order are clearly and understandably indicated on the order summary.Before placing the order, the Customer is required to confirm this summary.

The Customer may return to their order, complete it, modify it, or cancel it as long as it has not been validated. Once the Customer has clicked on the button "ORDER WITH PAYMENT OBLIGATION", the order will be validated.

This validation is subject to the prior acknowledgment and express and unconditional acceptance, via a checkbox, of these General Terms and Conditions of Sale and the Personal Data Protection Policy by the Customer, and implies a payment obligation.

Once the order is validated, the Customer will choose their delivery address and then their payment method.

ATV CYCLES may need to repackage or have certain Products repackaged. These Products, delivered to Customers, remain new products unless otherwise stated in the case of second-hand Products.

5.3 Payment terms

Prices will be charged based on the rates in effect at the time of the order.

The Client will pay the price directly on the Site, and necessarily before any execution by ATV CYCLES, in accordance with the process provided for this purpose.

ATV CYCLES offers various payment methods:

  • By credit card with immediate or deferred payment (CB, VISA, MASTERCARD) through a third-party secure payment system MONETICO provided by CIC LYONNAISE DE BANQUE. 3D secure payment is an additional authentication method that secures your payment by ensuring that you are indeed the one making the purchase. No banking data is processed through the systems of ATV CYCLES. To benefit from this, the Client's credit card must necessarily have the 3DS functionality, which is the case for almost all new cards. After entering the Client's banking details (card numbers, expiry date, and visual cryptogram), they will be automatically redirected to their bank's authentication site. Once authentication is validated by their bank, the Client will be redirected to the ATV CYCLES page and will receive a confirmation of their order.
  • By PAYPAL. The Client must have an account with PAYPAL to proceed with payment according to the conditions established by PAYPAL. This is the only account where you register your banking details.
  • Payment in 3 or 4 instalments without fees by credit card with our partner FLOA for amounts between 50 and 5000 Euros including VAT. Our financial partner FLOA offers payment solutions for your purchases of goods and/or services, deferred, in 3 or 4 instalments by credit card. These payment solutions are reserved for individuals (adult natural persons) residing in France, holders of a Visa or MasterCard credit card with a validity date corresponding to the duration of the repayment. We draw your attention to the fact that if you request to pay for your order of goods and/or services using these payment solutions, your personal data will be transmitted to FLOA for the purpose of assessing your financing request, managing your credit contract and, if applicable, for collection. Payment by the Client is a necessary prerequisite for the validation of their order. Failure to make immediate payment or payment by the due date will automatically result, without prior notice and by operation of law, in the suspension or invalidation of the Client's order, without prejudice to any other course of action.

The sale is considered final upon the registration of the order after the Customer receives the order confirmation email. At this stage, the order status appears as "Order Pending" in the "My Orders" section of the Customer's "My Account" area. The status then changes to "Order in Progress" when it is processed by ATV CYCLES for dispatch.

An invoice summarising all the Products and Services ordered by the Customer as well as their respective costs will be systematically made available to the Customer in their 'My Account' area under the 'Orders' section via a download link.

In the event of fraudulent use of any payment method, the cardholder is advised to immediately contact their bank to find out the procedures to follow and the terms of reimbursement. The Customer may demand the cancellation of the payment and the refund of any amounts paid by providing ATV CYCLES with a copy of the police report.

5.4 Transfer of ownership and risks

ATV CYCLES retains full ownership of the Products sold until full payment of the order price, including principal, fees, and taxes, has been received.

ATV CYCLES reserves the right to reclaim products sold and not paid for. In this regard, in the event of a reclamation, the Customer agrees not to modify, incorporate, resell, or pledge the sold products until full payment has been made.

The risk of loss and deterioration is transferred to the Customer upon receipt of the Products by the Customer or a third party designated by the Customer. The Customer is responsible for the proper preservation of the ordered and delivered Products.

6. PROMOTIONAL CODES, COMMERCIAL OFFERS & NEWSLETTERS

6.1 Promotional codes

Promotional codes applicable to all or certain purchases of specific Products and Services made on the Site or on delivery charges may be offered at any time by ATV CYCLES as part of promotional actions.

These promotional codes may take the form of percentage (%) discounts or reductions in Euros (€) as defined in paragraph 5.2.Prices & Taxes.

The use of the promotional code is defined in these terms and conditions.

Promotional codes are valid for a limited period and can be used only once for a single order. They are non-transferable and cannot be exchanged or purchased from ATV CYCLES. Unless otherwise stated, the Customer who has received the promotional code will be the only one entitled to benefit from it. A minimum and/or maximum purchase amount may be specified for each promotional code.

The use of a promotional code applies as follows:

  • The Customer must enter their promotional code at the time of validating the basket. Promotional codes are not applicable to orders that have already been validated.

  • In the event that the value of the order exceeds the amount of the discount indicated in the promotional code, the difference between the amount of the promotional code and the amount of the order will be the responsibility of the Customer, who must pay it by any of the payment methods offered.

  • In the event that the value of the order is less than the amount of the discount indicated in the promotional code, the difference between the amount of the promotional code and the amount of the order will not result in a refund to the Customer by ATV CYCLES, nor the issuance of a new promotional code equivalent to the difference in value between these two amounts.

In the case of a total or partial return of the Products concerned by a promotional code, the amount of the promotional code applied to the order related to the returned Product will be deducted from the amount refunded to the Customer by ATV CYCLES.

In the event of fraudulent use, sales, losses, falsifications, technical errors beyond the control of ATV CYCLES that affect the proper functioning of the promotional code, ATV CYCLES reserves the right to modify, suspend, or cancel it. No refunds or new issuances in favour of the Use will be made by ATV CYCLES.

The Client acknowledges and agrees that they have been made aware, prior to any use, of the additional specific conditions related to the use of a promotion (offers, promotional codes, etc.) concerning the duration of use, the reduced price, the value of the voucher, etc., which will be directly provided in the commercial offers sent to Clients and/or published on the Site.

6.2 Commercial offers & Newsletters

Newsletters are commercial emails that the Client receives regularly in their personal inbox to inform them of the latest news on Products and Services, various updates related to the activities of ATV CYCLES, or for the promotion of Products and Services (promotional codes or simple indications of price reductions on a Product or Service) on the Site.

Commercial offers are communicated to the Client, notably either by:

  • A publication displayed on the Site (via a specific promotional banner, via the catalogue or product sheet, via the service description, etc.),
  • A partner advertising/media campaign (displayed on leaflets, newspapers, magazines, third-party sites, etc.),
  • A promotional email sent by ATV CYCLES to the Client.

Excluding publications on the Site and advertising campaigns, to receive commercial offers and newsletters by email, the Client must:

  • Having given consent by ticking the box provided for this purpose when creating their customer account,
  • Or having given consent at the bottom of the Site page by entering their email in the section provided for this purpose ("newsletter subscription").
  • Or having given consent by ticking the box provided for this purpose on the order confirmation page.

If the Customer wishes to receive commercial offers and newsletters by email, ATV CYCLES invites the Customer to log in to the Site and accept the receipt of promotional emails. Without this, ATV CYCLES cannot be held responsible for the failure to receive commercial offers and newsletters from ATV CYCLES.

The use of the newsletter at the bottom of the Site page is strictly reserved for personal use, intended to be sent to the User's email address and in no case to the email of a third party for which they have not been duly authorised by the third party and by ATV CYCLES.

ATV CYCLES disclaims any responsibility that may be contrary to the use of the Service mentioned in the T&Cs. The Customer agrees to fulfil their obligations and not to infringe the private rights of third parties through fraudulent use of the Service.

The Customer who wishes to unsubscribe from the newsletters must follow the "Unsubscribe" link that ATV CYCLES provides and which appears at the bottom of the email received by the Customer. It is simply a matter of following this link and clicking on "Unsubscribe".

7. DELIVERY

The delivery charges related to the order are indicated to the Customer before any payment for the order and only concern deliveries made to the countries explicitly listed (excluding areas excluded from certain countries) in paragraphs 7.1 – Standard products, 7.2 – Frame kits and 7.3 – Bulky products or covered by the ADR standards.

ATV CYCLES reserves the right to temporarily or permanently exclude certain countries explicitly listed in paragraphs 7.1 – Standard products, 7.2 – Frame kits and 7.3 – Bulky products or covered by the ADR standards for technical reasons related to the proper functioning of the Site or due to cost or logistical constraints beyond its control. In this case, it will not be possible for the Customer to choose a delivery address in the countries affected by this restriction and to proceed with their purchase.

Delivery to the DROM-COM, PO boxes and military bases is excluded. These delivery charges are listed on a separate line of the invoice associated with the order.

The company ATV CYCLES is open from Tuesday to Saturday. Once the order and payment are validated, if it is placed before 12:00 (local time) from Tuesday to Friday only, it will be processed and prepared for dispatch within an average of 24 hours. However, this timeframe may vary from 12 to a maximum of 72 hours for any order placed after 12:00 (local time), or from Saturday to Monday inclusive, or during public holidays, and/or depending on the Products and Services ordered. This excludes out-of-stock Products or Products on reorder. The status of the order is accessible in the 'My account' section.

Unless otherwise stated on the Site during the ordering process or in the description of the Products and Services ordered, ATV CYCLES commits to delivering the Products within the processing, preparation, and shipping times mentioned in paragraph 7.

ATV CYCLES will provide the Customer with a tracking number allowing them to check their shipment status at any time via email or in the 'Orders' section of the 'My Account' area. Products within the same order are delivered at once (excluding bulky Products). In the event that ATV CYCLES splits the order into multiple packages, the Customer will only be charged delivery fees once.

For Products on restock that may be offered for sale on the Site and ordered by the Customer, ATV CYCLES commits to informing the Customer of their actual availability as soon as they are received at ATV CYCLES, without this delay exceeding 30 days from the day of the order and payment by the Customer. Once ATV CYCLES receives the products ordered by the Customer, the conditions for processing, preparation, and shipping then apply as if it were a Product in stock and apply without exception.

For any order placed on a Saturday, Sunday, or public holiday, the delivery time is counted from the first working day following.

As ATV CYCLES has a physical store, any order can be picked up directly at the premises of ATV CYCLES.

In the other case, ATV CYCLES delivers to the Customer at the address of their choice (home, office, or Collection Point) depending on the category of Products ordered by the Customer (Standard, Frame Kits, Bulky Products) and within the timeframes based on the delivery method chosen by the Customer or imposed by ATV CYCLES.

In the event that the order includes a product from the Frame Kit category, the entire order then falls under this same category (excluding bulky products).

For bulky products, these are always shipped individually regardless of the other products included in the customer's order.

7.1 Standard products

For any order placed before 12:00 (local time) from Tuesday to Friday.

This category includes all products offered for sale by ATV CYCLES excluding Frame Kits and excluding bulky products or those covered by the ADR standard.

7.1.1 METROPOLITAN FRANCE & MONACO (EXCLUDING CORSICA)

  • CHRONOPOST – 2SHOP DIRECT – 48h:delivery to PICKUP Points from Monday to Saturday at the price of€5.90 including VAT(free for orders over €199.00 including VAT). For national shipments, the times are understood for collection from Monday to Friday and for delivery from Monday to Saturday, depending on the opening days of the PICKUP Points, and excluding public holidays. For any deposit made on Saturday, the times are understood for collection from the following Monday. For certain coastal islands, the delivery time may be extended by one day. The delivery times communicated by CHRONOPOST are for informational purposes only. List of PICKUP Points onhttp://www.chronopost.fr/expeditionAvancee/ounoustrouver.html
  • COLISSIMO WITH SIGNATURE – 48h:Home delivery from Monday to Friday from 8am to 6pm and on Saturday between 8am and 1pm excluding public holidays at a fixed price of€7.90 including VAT(free for orders over €199.00 including VAT).
  • CHRONOPOST – CHRONO 13:next day delivery before 1pm at the price of€9.90 including VAT. The day after public holidays, delivery may occur on the same day without a guaranteed timeframe. For certain coastal islands, the delivery time may be extended by one day. Packages collected on Saturday or the day before public holidays destined for Corsica will be delivered on Tuesday or the day after the public holiday.
  • CHRONOPOST – CHRONO RELAIS – 24H:Next day delivery to one of the 16,000 PICKUP points at the price of€8.90 including VAT. List of PICKUP points onhttp://www.chronopost.fr/expeditionAvancee/ounoustrouver.html

7.1.2 CORSICA

  • CHRONOPOST – 2SHOP DIRECT – 48h:Delivery to PICKUP points from Monday to Saturday at the price of€6.90 including VAT(free for orders over €199.00 including VAT). For national shipments, the times are understood for collection from Monday to Friday and for delivery from Monday to Saturday, depending on the opening days of the PICKUP points, and excluding public holidays. For any deposit made on Saturday, the times are understood for collection from the following Monday. For certain coastal islands, the delivery time may be extended by one day. 7.1.3 EUROPE

7.2.1 METROPOLITAN FRANCE & MONACO

For certain coastal islands, the delivery time may be extended by one day. 7.2.2 EUROPE

7.3 Bulky products or those subject to ADR standards

This category includes assembled cycles, frame kits (bicycles disassembled with wheels), transport cases or products covered by the ADR standard (batteries for example).

7.3.1 METROPOLITAN FRANCE

  • GEODIS – FRANCE EXPRESS:Home delivery from Monday to Friday between 8am and 6pm excluding public holidays at a fixed price of€49.90 inc. VAT. Your order will be delivered to your home via the France Express service of the carrier GEODIS. As soon as your package is handed over to the carrier, you will receive an email and a text message from GEODIS containing a link to the dedicated interface where you can schedule your delivery appointment. You can choose delivery to the address of your choice, specify any useful information (address supplement, door code, phone number, etc.), and select your delivery time slot: weekdays, from 8am to 1pm or from 1pm to 6pm. 

7.3.2 EUROPE([1],[2] and [3])

  • GEODIS – FRANCE EXPRESS:Home delivery from Monday to Friday between 8am and 6pm excluding public holidays at a fixed price of€69.90 inc. VAT. Your order will be delivered to your home via the France Express service of the carrier GEODIS. As soon as your package is handed over to the carrier, you will receive an email and a text message from GEODIS containing a link to the dedicated interface where you can schedule your delivery appointment. You can choose delivery to the address of your choice, specify any useful information (address supplement, door code, phone number, etc.), and select your delivery time slot: weekdays, from 8am to 1pm or from 1pm to 6pm.

7.4 Delivery anomalies

7.4.1 Client absence

The Client is obliged to provide all the necessary information for the proper execution of the delivery of the ordered Products: first name, surname, delivery or collection address and billing address if different from the delivery address, as well as a phone number with the country code.

If the Client is absent on the day of delivery, a delivery notice will be left by the carrier. The Client can then arrange with the carrier for the collection of the ordered Products within the timeframe indicated by the latter:

  • Colissimo and Chronopost: 15 calendar days,
  • GEODIS – France Express: By appointment only.

After these deadlines, the Products will be automatically returned to ATV CYCLES. In case of difficulties, the Client must inform ATV CYCLES within the same timeframe.

7.4.2 Delivery delay

Any delay in delivery compared to the date or timeframe indicated to the Client at the time of their order, or in the absence of a date or timeframe indication at the time of the order exceeding thirty (30) days from the order, may lead to the cancellation of the sale at the Client's initiative, upon written request from them by registered letter with acknowledgment of receipt, if after having instructed ATV CYCLES to make the delivery it has not been executed. The Client will then be refunded, no later than fourteen (14) days following the date on which the contract was terminated, for the total amount paid. This clause does not apply if the delay in delivery is due to a case of force majeure.

7.4.3 Anomalies: damage, missing product, broken or damaged, damaged package

Regardless of the delivery method, the Customer is required to check the condition of the package. The Customer may refuse a package at the time of delivery if they notice any anomalies regarding the delivery (damage, missing product compared to the delivery note, damaged package, broken or damaged product(s), etc.). They must inform the carrier upon receipt, by making reservations on the delivery note presented by the carrier, and the package will be returned to ATV CYCLES at no cost to the Customer.

The Customer will also be required to notify ATV CYCLES of any anomalies observed at delivery within 72 hours from the date and time when the order is marked as 'delivered' on the delivery tracking. The same will apply for any package marked as delivered by the carrier but not received.

If the Customer fails to notify their reservations within the allotted time, the Customer is deemed to have accepted the Products without any anomalies. The delivered Products will thus be considered free from any defects and no claims for damage, missing products, broken or damaged items, or damaged packages will be validly accepted by ATV CYCLES.

The Customer nevertheless retains the benefit of the legal warranty, compliance, and hidden defects.

7.4.4 Client refusal by mistake

If the Customer has mistakenly refused the package, they may request its reshipment by first paying the postal fees for a new shipment. Shipping costs must be paid even for orders where shipping was offered at the time of the order.

8. RETURN OF PRODUCTS

8.1 Right of withdrawal

The Client has a period of fourteen (14) clear days from the delivery of the Products to exercise their right of withdrawal under the applicable conditions set out in the Consumer Code, without having to provide any reason or pay any penalties. If this period expires on a Saturday, Sunday, or public holiday, it is extended to the first working day following.

If they wish to exercise their right of withdrawal, the consumer Client must inform ATV CYCLES of their decision to withdraw from the contract within this fourteen (14) day period, by returning the relevant products, either:

  • By means of theformmade available to them on the Site;

OR

  • by presenting any other explicit and unambiguous statement to this effect (for example, a letter sent by registered mail with acknowledgment of receipt).

In any case, the Client must indicate a clear and unambiguous intention to withdraw.

In the event of a withdrawal made on the Site by the online submission of the withdrawal form, ATV CYCLES will send the Client, without delay, an acknowledgment of receipt on a durable medium, to the email address provided at the time of their order.

In the event of the Client exercising their right of withdrawal, all sums paid by the Client will be refunded by ATV CYCLES within fourteen (14) days from the date on which they are informed of the Client's decision to withdraw.

This refund is conditional upon compliance with and application of the conditions set out in paragraphs 8.2 and 8.3. The refund will be made to the Client's bank account directly through the Site by bank transfer or by any other means agreed upon by the parties.

Exception to the right of withdrawal:The Site offers the sale of the following Products and Services, for which the right of withdrawal for Consumer Clients cannot apply, pursuant to Article L.221-28 of the Consumer Code:

  • custom bicycle assembly (supply of goods made to the consumer's specifications or clearly personalised). In this case, all Products, such as parts, components, and accessories, included in this Service are excluded from the right of withdrawal;
  • sale of food products for athletes (solid products and energy drinks).

The Client acknowledges having been informed of this list of exceptions, notified prior to the sale in these General Terms and Conditions.

Furthermore, Services that begin immediately after purchase and are fully executed before the end of the withdrawal period do not allow the Client to benefit from their right of withdrawal if they have expressed a waiver of their right of withdrawal. The right of withdrawal cannot be exercised in the context of the provision of digital content not supplied on a tangible medium, the execution of which has begun before the end of the withdrawal period with the Client's express waiver of their right of withdrawal.

8.2 Reshipment

For the Client who has exercised their right of withdrawal, ATV CYCLES will provide the Client with a prepaid return label at the standard rate to be affixed to the package.

The Customer who does not use the prepaid return label at the standard rate and who chooses another delivery method must pay the return costs upfront and, if applicable, according to the conditions below, they will be covered by ATV CYCLES based on the standard rate upon acceptance and presentation of proof.

The Customer is expressly informed that the relevant Products must be returned to ATV CYCLES:

  • Before the expiry of the 14 calendar days starting from the sending of the withdrawal request to ATV CYCLES;
  • Complete, in their original packaging, including the provided instructions and/or any accessories;
  • In perfect condition for resale, functioning, clean, and undamaged;
  • In conditions aimed at ensuring the full and complete preservation of the Products and their original state, perfectly secured, in a closed packaging box and labelled in accordance with the carrier's shipping standards;
  • With the withdrawal form attached inside the package;
  • To the address: 5171 route des Trois Villages – 38660 Plateau des Petites Roches – France

The return of an order containing a bulky item or subject to ADR standards will be exclusively returned via the carrier France Express, with an appointment.

For any reshipment, the Customer will keep the deposit slip and the collection number as proof.

ATV CYCLES reserves the right to refuse the return of the relevant Products in case of non-compliance with the aforementioned instructions or for any products that are damaged, broken, worn, or unfit for use or assembly in accordance with the manufacturer's specifications.

8.3 Refund

The refund will be made using the same payment method as that used by the Customer when placing their initial order, unless a refund using the initial payment method proves impossible or if the Customer and ATV CYCLES agree on a different method.

The different refund method used by ATV CYCLES is bank transfer. The Customer must first return their Product and then provide ATV CYCLES with their Bank Identity Statement (RIB-IBAN) information at their sole and entire responsibility.

ATV CYCLES reserves the right to refuse the refund of the affected Products in the event of non-compliance with the instructions set out in paragraph 8.2 or in the case of incorrect, incomplete or poorly provided contact details/input by the Customer that may have led to a failure to reship and deliver to the address of ATV CYCLES, which in these cases cannot be held responsible.

9. PRODUCT WARRANTY

When acting under the legal guarantee of conformity, the consumer benefits, for a new item, from a period of two years from the delivery of the item to take action and for a second-hand item, from a period of one year from the delivery of the item to take action; they can choose between repair or replacement of the item, subject to the cost conditions provided for in Article L.217-9 of the Consumer Code; except for second-hand goods, they are exempt from proving the existence of the conformity defect of the item during the 24 months following the delivery of the item.

The legal guarantee of conformity applies independently of any commercial guarantee that may be granted.

The consumer may decide to invoke the warranty against hidden defects of the sold item as defined in Article 1641 of the Civil Code, unless ATV CYCLES has stipulated that it will not be obliged to any warranty; in the event of invoking this warranty, the buyer has the choice between the cancellation of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code. They have a period of two years from the discovery of the defect.

The postponement, suspension, or interruption of the limitation period cannot have the effect of extending the extinctive limitation period beyond twenty years from the day the right was born in accordance with Article 2232 of the Civil Code.

All Products purchased on the Site benefit from the following legal warranties, provided for by the Civil Code and the Consumer Code:

9.1. Legal compliance warranty

According to Articles L.217-4 and following of the Consumer Code, ATV CYCLES is obliged to deliver a good that is in conformity with the contract concluded with the consumer Client and to respond for any conformity defects existing during the delivery of the Product. The conformity warranty may be exercised if a defect existed on the day of taking possession of the Product.

However, when the defect appears within 24 months following this date, or 12 months for second-hand Products, it is presumed to meet this condition. However, in accordance with Article L.217-7 of the Consumer Code, "ATV CYCLES may contest this presumption if it is not compatible with the nature of the Product or the alleged lack of conformity." In this regard, ATV CYCLES may analyse the disputed Product to determine whether the identified defect existed on the day the Product was delivered to the Customer. On the other hand, after this period of 24 months, or 12 months for second-hand Products, it will be the Customer's responsibility to prove that the defect indeed existed at the time of taking possession of the Product.

In accordance with Article L.217-9 of the Consumer Code: "in the event of a lack of conformity, the Customer chooses between repair and replacement of the good. However, ATV CYCLES may not proceed according to the buyer's choice if this choice results in a manifestly disproportionate cost in relation to the other option, taking into account the value of the good or the significance of the defect. It is then required to proceed, unless impossible, according to the option not chosen by the buyer."

The legal guarantee of conformity does not apply:

  • If the Customer was aware of the defect at the time of purchase;
  • If the Customer could not have been unaware of the defect at the time of purchase. (For example, if ATV CYCLES had informed the Customer of it);
  • If the defect results from any parts, components or accessories that the Customer provided or added that would be non-compliant and/or incompatible with the Product;
  • On wear parts and consumables;

 

It also does not apply to the Product in the following cases:

  • Non-compliant use for which the product is intended (inappropriate use for practice);
  • Defects and their consequences due to the intervention of the buyer, a repairer, or external sources;
  • Damage specifically mentioned in the product sheet;
  • From normal wear and tear;
  • During improper handling, negligent maintenance, or failure to comply with assembly instructions, torque settings, maintenance, cleaning, recommended pressure, washing, etc.;
  • During improper handling, inappropriate storage, or failure to comply with instructions related to electric bicycles and their accessories (batteries, chargers, cables, etc.);
  • In case of using incompatible maintenance, lubrication, or cleaning products;
  • Failure to comply with the assembly instructions;
  • For defects or malfunctions resulting from shocks, impacts, falls.

9.2. Legal warranty against hidden defects

According to Articles 1641 to 1649 of the Civil Code, the Client may request the exercise of the warranty for hidden defects if the defects presented were not apparent at the time of purchase, were prior to the purchase (and therefore do not result from normal wear and tear of the Product, for example), and are sufficiently serious (the defect must either render the Product unfit for the use for which it is intended, or diminish that use to such an extent that the buyer would not have purchased the Product or would not have purchased it at such a price had they known of the defect).

Claims and requests for a refund for a non-compliant Product must be made by postal mail or email to the addresses indicated in the legal notices of the Site. The Customer will be refunded by bank transfer for the amount of their order. The costs of the refund procedure (notably the return shipping costs of the Product) will remain the responsibility of ATV CYCLES.

9.3. Commercial or contractual guarantee

The commercial or contractual warranty allows the Customer to be refunded, replaced, or have a purchased product repaired. It is freely offered by ATV CYCLES or the manufacturer of the Product. It can be free or paid. It is optional and of variable duration.

The commercial or contractual warranty is different from the legal guarantees of conformity and hidden defects. It is in addition to them and can extend them, but does not replace them.

All bicycles are guaranteed for a minimum of 2 years on the frame and parts for the first purchaser.

Some brands go beyond the legal duration and offer specific and/or extended warranty periods.

9.4. Request for guarantee

For any warranty claim, the Customer will contact ATV CYCLES by email at the following address:contact@atv-cycles.fr, explaining the problem and the circumstances in which it occurred, illustrated with photos or videos.

The Customer must provide the order number, the invoice, and the product serial number.

Upon receipt, ATV CYCLES will process the Customer's request and one of its technicians will get back to the Customer with the conclusions of their assessment in order to:

  • Request additional information, if necessary, to study the Customer's request;

or

  • if the warranty claim is validated, ATV CYCLES will inform the Customer about the product return procedure;

or

  • if the warranty claim is not validated, ATV CYCLES may offer an alternative;

Reminder: the shipping and return of the product under warranty is, in this case, the responsibility of ATV CYCLES.

Deadlines: Upon validation, the warranty claim cannot predict a firm and definitive deadline from ATV CYCLES regarding the return of the Product to the Customer. The same applies to any alternative solution. ATV CYCLES will inform the Customer of an estimated timeframe, will strive to minimise it, and will inform the Customer of any delays that may occur during the processing of the Customer's request.

10. LIABILITY

Each party assumes responsibility for the consequences resulting from its faults, errors, or omissions that cause direct damage to the other party.

10.1. Client's liability

The Customer is solely responsible for the quality, accuracy, relevance, and correctness of the information they provide on the Site for their order. The liability of ATV CYCLES cannot be engaged in this regard. The Customer acknowledges that ATV CYCLES is only bound by an obligation of means.

Given the technical nature of certain Products sold, the Customer must strictly adhere to the technical specifications and safety recommendations of the manufacturer, whether for storage, assembly, or use of these Products.

The Customer is required to refer to the user and/or assembly instructions provided with the ordered Product. The Customer is therefore solely responsible towards ATV CYCLES and, where applicable, third parties, for any damages, direct or indirect, of any nature whatsoever, caused by any information or other publication communicated, transmitted or disseminated in connection with these terms, as well as for any breach on their part of these contractual stipulations.

The Customer is also solely responsible for the choice of Products and Services they have ordered through the Site.

Every Customer agrees not to use the Site in violation of all applicable laws, rules, and regulations.

10.2. Liability of ATV CYCLES

ATV CYCLES implements all measures necessary to ensure the Customer receives quality Products and Services under optimal conditions. It assumes full responsibility for the Products and Services it offers and sells to Customers through the Site and will solely handle any potential claims related to said Products and Services.

ATV CYCLES ensures the proper functioning of the Site.

However, ATV CYCLES cannot be held responsible for:

  • Any damage resulting from the installation or use of the Products by the Customer;
  • Any damage that would be attributable either to the Customer, or to an unforeseeable and insurmountable event caused by a third party outside the contract, or to a case of force majeure;
  • Non-coverage by the Customer's insurance;
  • Content from websites directly or indirectly linked to the Site that are not under the control of ATV CYCLES;
  • Due to the fact that it cannot in any case guarantee that the Site is free from anomalies or errors and that it operates without interruption;
  • from non-functioning, an inability to access or malfunctions of the services of the Clients' internet service provider, to those of the Internet network.

Unless otherwise provided by public order or mandatory provisions, for all damages and losses that may arise as a consequence of total or partial non-performance or faulty performance of its contractual or extra-contractual obligations, ATV CYCLES shall only be liable for the actual and proven damages and losses incurred by the Client that are the immediate consequence thereof, without the total amount of damages and compensation payable by ATV CYCLES, all generating events combined, exceeding the amount of the invoice for the sale in question.

This limit also applies to all consequences, including restitution by equivalent, that would oppose ATV CYCLES in the event of nullity or termination of the sale.

ATV CYCLES shall not be liable in any case for indirect damages suffered by the Client such as, but not limited to, loss of income, loss of turnover, loss of profits, loss of anticipated savings, or any indirect or derived damage, cost or expense.

11. FORCE MAJEURE

‘Force majeure’ is defined as any event beyond the control of one of the parties and not reasonably foreseeable at the conclusion of these General Terms and Conditions of Sale. Such an event will be characterised when the party, victim of such an event, is prevented from properly fulfilling its contractual obligations, despite the implementation of adequate and appropriate measures intended to limit its effects.

Neither party shall be held liable to the other for non-performance or delays in the performance of an obligation arising from these General Terms and Conditions of Sale that are due to the other party as a result of the occurrence of a force majeure event, as recognised and defined by French case law.

The force majeure case suspends the obligations arising from these General Terms and Conditions for the entire duration of its existence, and neither party may, during this period, validly invoke the existence of such a force majeure case as defined in Article 1218 of the Civil Code to justify the termination of its contractual relationship with the other party. However, if the force majeure case lasts for more than thirty (30) consecutive days, it would entitle either party to terminate these General Terms and Conditions by operation of law, eight (8) days after sending a registered letter with acknowledgment of receipt notifying this decision.

12. INTELLECTUAL PROPERTY

The Site, as well as the databases, texts, documents, information, images, photographs, graphics, logos, or any other data remain the exclusive property of ATV CYCLES or, where applicable, their respective holders from whom ATV CYCLES has obtained exploitation rights.

ATV CYCLES remains the holder of all intellectual property rights related to its registered trademark, as well as all intellectual property rights and copyright related to any other distinctive sign belonging to it.

The Site uses elements (images, photographs, content) credited to: Alain Doucé, Chiru Bikes, Pierre Arnaud Le Magnan, Michel Lavail, and ATV CYCLES.

Any reproduction and/or representation, downloading, translation, adaptation, exploitation, distribution, dissemination and/or communication, in any form whatsoever, for commercial purposes or not, of all or part of the brand and/or an original or provided work contained on the Site is strictly prohibited. The Client also refrains from any action and any act that may directly or indirectly infringe the intellectual property rights of ATV CYCLES.

13. PERSONAL DATA PROTECTION

The Client is informed that the creation of their personal account on the Site as well as their order of Products and Services on the Site results in the collection and automated processing of personal data concerning them by ATV CYCLES, the use of which is subject to the provisions of Law No. 78-17 of 6 January 1978 relating to Computing, Files and Liberties, as amended by Law No. 2016-1321 of 7 October 2016 and European Regulation 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the “GDPR”).

ATV CYCLES provides the Client, on its Site, aprivacy policyspecifying all the information related to the use of the Client's personal data collected by ATV CYCLES and the rights the Client has regarding this personal data.

14. COOKIES

ATV CYCLES uses "cookies" to obtain statistical processing and improve the Client's browsing experience.

ATV CYCLES places a cookie on the Client's computer with their prior consent. The Client has the option to refuse cookies when visiting the Site. The retention period for this information on the Client's computer is 13 months.

ATV CYCLES commits to never disclosing the content of these cookies to third parties, except in the case of a legal request.

The Client may also oppose the recording of cookies by configuring their browsing software. To do this, the Client will adjust their browser settings:

15. HYPERTEXT LINKS

The Site may include hyperlinks to other sites.

ATV CYCLES cannot, under any circumstances, be held responsible for the technical availability of websites or mobile applications operated by third parties that the Client may access through the Site. Furthermore, ATV CYCLES cannot accept any responsibility for the content, advertisements, Products, and Services available on or from these sites, mobile applications, or external sources.

If, despite ATV CYCLES' efforts, any of the hyperlinks present on the Site pointed to a website or internet source whose content was or appeared to be non-compliant with French law to a Client, the Client agrees to immediately contact the publication director of the Site, whose contact details are provided in the legal notices published on the Site, in order to inform them of the address of the pages of the third-party site in question. ATV CYCLES will then take the necessary steps to remove the relevant hyperlink.

16. APPLICABLE LAW AND COMPETENT JURISDICTION

These General Terms and Conditions of Sale are governed by French law.

Any complaint can be made via the contact form available in the 'contact' tab, and ATV CYCLES will respond to the Client as soon as possible.

In the event of a dispute to which these General Terms and Conditions of Sale (or any of their clauses) and/or the relationships between the parties may give rise, the consumer Client may choose to bring the matter before one of the territorially competent jurisdictions under the Code of Civil Procedure, or the jurisdiction of the place where they resided at the time of the conclusion of the contract or the occurrence of the damaging event. The professional Client must bring the matter before the Court within the jurisdiction of which ATV CYCLES has its registered office.

According to Article L.612-1 of the Consumer Code, it is reminded that "every consumer has the right to access a consumer mediator free of charge in order to achieve an amicable resolution of the dispute with a professional. To this end, the professional guarantees the consumer effective access to a consumer mediation system. ».

In accordance with ordinance no. 2015-1033 of 20 August 2015 and the implementing decree no. 2015-1382 of 30 October 2015, any dispute or so-called consumer litigation, subject to Article L.612-2 of the Consumer Code, may be subject to amicable resolution through mediation with the following mediator:CM2C – Centre for Consumer Mediation of Justice Conciliators

To submit their dispute to the mediator, the Client can:

  • (i) fill out the form on the mediator's website:https://www.cm2c.net/or,
  • (ii) envoyer sa demande par courrier simple ou recommandé à CM2C – Centre for Consumer Mediation of Justice Conciliators – 14 rue Saint Jean – 75017 PARIS, or,
  • (iii) send an email tocm2c@cm2c.net.

It is reminded that mediation is not mandatory but is only offered to resolve disputes while avoiding recourse to the courts.

It is reminded that, as a general rule, and subject to the assessment of the Courts, compliance with the provisions of the CGUV relating to the contractual guarantee assumes that the Client honours their financial commitments to ATV CYCLES.
